Statute of Limitations in California

In every state, there are time limits for the filing of lawsuits and other civil actions called Statutes of Limitations. These laws are intended to create general practicability and fairness when filing lawsuits.  They are also designed to prevent stale claims from being pursued where evidence and witnesses are lost.

In California, a Plaintiff typically has two years to bring a claim for personal injuries. (Code of Civil Procedure §335.1).

It is very important to note that this can be a very complicated area of the law, and it is important for an experienced attorney to review the factual details of each matter to determine the applicable statute of limitations.
